1.Who We Are

Talk2Sam is a registered trade name (DBA) operated by a sole proprietor based in the State of Arizona, USA. We operate the website at www.talk2sam.live, the Talk2Sam exercise and nutrition application (the "App"), and all related programs, digital products, coaching services, and content (collectively, the "Services").

For all inquiries — including billing, account access, and legal notices — please use our official contact page at talk2sam.live/contact-us. Our registered business address is available upon request through that page.

2.Acceptance of Terms

By creating an account, making a purchase, downloading a free resource, or using any portion of our Services, you acknowledge that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. Use of our Services by anyone under 18 is strictly prohibited.

3.Health, Medical & Safety Disclaimer

Talk2Sam provides fitness, nutrition, and motivational content for educational and informational purposes only. Nothing in our Services constitutes medical advice, diagnosis, or treatment. The Unhinged Motivational Madness™ program is not a substitute for professional medical consultation.

Our programs include high-volume exercise protocols (up to 200 push-ups daily and 60+ minutes of cardio), caloric deficits, and extended fasting (24–72 hours). These carry inherent physical risks. You must consult a licensed physician before beginning, especially if you have pre-existing health conditions, are pregnant or nursing, or take prescription medications.

By using our Services, you voluntarily assume all associated risks and release Talk2Sam, its owner, employees, and affiliates from any liability arising from injury, illness, or adverse health outcomes.

4.Products, Services & Pricing

All prices are displayed and charged in United States Dollars (USD). Talk2Sam offers the following:

We reserve the right to modify pricing at any time. Price changes will not affect active subscription periods already paid. If we discontinue a paid service, existing subscribers will not be affected mid-billing-period.

5.Payment Processing & PCI Compliance

All transactions are processed exclusively in USD by our payment processor, Stripe, Inc., a PCI-DSS Level 1 certified payment service provider. By completing a purchase, you also agree to Stripe's Services Agreement.

Talk2Sam never stores, processes, or has access to your full credit card number, CVV, expiration date, or bank account details. All cardholder data is transmitted directly to and held exclusively by Stripe. Our website uses HTTPS encryption on all pages, and our payment forms are Stripe-hosted, meaning no card data passes through our own servers. We comply with PCI-DSS standards as applicable to merchants using third-party hosted payment pages.

We accept all major credit and debit cards supported by Stripe. Accepted card brand logos are displayed at the point of checkout.

6.Subscription Terms & Cancellation Policy

Monthly App subscriptions are billed on a recurring basis on your billing date each month in USD.

• You may cancel at any time through your account settings or by submitting a request via talk2sam.live/contact-us.
• Upon cancellation, you retain full access until the end of your current paid billing period. Access is not terminated early.
• Cancellation takes effect at the end of the then-current billing cycle. You will not be charged again after cancellation is confirmed.
• No free trial is offered. Subscription access begins immediately upon payment.

7.Refund Policy

One-Time Coaching Sessions: Non-refundable once payment is confirmed. If Talk2Sam is unable to fulfill a scheduled Zoom session, you will receive a full credit or reschedule at no cost. If you miss a session without providing at least 24 hours' advance notice, the session is considered fulfilled and no refund or credit will be issued.

Free Downloads: The Unhinged Motivational Madness™ e-guide is available at no charge. No payment method is required.

Promotions & Discounts: Terms of any promotional offer will be disclosed clearly at the point of promotion. Promotional pricing applies only to the period explicitly stated.

8.Billing Disputes & Chargebacks

If you believe a charge to your account was made in error, please contact us before initiating a chargeback with your bank or card issuer. Most billing issues can be resolved directly and quickly.

To dispute a charge:

• Submit a ticket at talk2sam.live/contact-us with your full name, purchase email address, charge amount, and a description of the issue.
• Sam personally reviews all billing disputes and responds within 48 hours of submission.

Billing Mistakes: We stand behind every transaction. If our investigation confirms that a billing error occurred on our end — such as a duplicate charge, an incorrect amount, or a charge made after a confirmed cancellation — a full refund of the erroneous amount will be issued promptly. We are committed to making it right.

Initiating a chargeback without first contacting us may result in account suspension. Talk2Sam reserves the right to contest chargebacks that violate these Terms, including providing transaction records, these Terms, and relevant correspondence to Stripe and the applicable card network as evidence.

9.Intellectual Property

All content made available through our Services — including the Unhinged Motivational Madness™ program, the Talk2Sam name and logo, written guides, training protocols, nutritional blueprints, App software, video and audio recordings, and all other materials — is the exclusive intellectual property of Talk2Sam and is protected by applicable copyright, trademark, and trade secret laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content for personal, non-commercial use only. You may not reproduce, distribute, resell, sublicense, or create derivative works from any of our content without our express written consent.

10.User Accounts & Registration

You agree to provide accurate information when registering, maintain the confidentiality of your credentials, and notify us immediately of any unauthorized account access via talk2sam.live/contact-us. Talk2Sam is not liable for losses arising from your failure to protect your login credentials.

11.Third-Party Platforms & Integrations

Our Services use the following third-party platforms, each operating under their own terms and privacy policies:

• Stripe, Inc. — Payment processing. PCI-DSS Level 1 certified. Talk2Sam never handles raw card data. See stripe.com/privacy.
• Go High Level (GHL) — CRM, marketing automation, funnels, and customer communications. Acts as a data processor on our behalf.
• Zoom Video Communications — Live coaching sessions. Subject to Zoom's own terms and privacy policy.

Third-party links appearing in our content are provided for convenience only. We do not endorse or take responsibility for third-party content, products, or services.

12.Prohibited Conduct

You agree not to use our Services to violate any applicable law; infringe intellectual property rights; transmit spam or malicious code; gain unauthorized access to our systems; harass or harm users or staff; misrepresent your identity; or scrape or extract data by automated means.

13.Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We make no guarantee of specific fitness, weight loss, or health results from following our programs, and do not warrant that our Services will be uninterrupted or error-free.

14.Limitation of Liability

To the maximum extent permitted by law, Talk2Sam and its owner, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services. Our total liability to you for any claim shall not exceed the total amount paid by you to Talk2Sam in the twelve (12) months preceding the claim.

15.Indemnification

You agree to defend, indemnify, and hold harmless Talk2Sam and its owner, agents, and employees from any claims, liabilities, damages, and expenses — including reasonable attorneys' fees — arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

16.Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arizona, United States of America, without regard to conflict of law provisions. You consent to the exclusive jurisdiction of courts in Arizona for any disputes. Disputes shall first be submitted to good-faith negotiation via our contact page. If unresolved within 30 days, they shall be settled by binding arbitration under the rules of the American Arbitration Association.

17.Changes to These Terms

We may update these Terms at any time. Changes are effective upon posting with an updated date. Continued use of our Services constitutes acceptance of the revised Terms.
